I'm too lazy to look for a link to the article, but this is what I read a few days ago.

This guy was having sex with his wife who was in a coma. His wifes sister suspected him of doing that so the police set up a hidden camera in the wifes hospital room. They caught the guy having sex with his comatose wife and he was arrested for "aggravated sexual assault".

Anyway the mans 4th amendment rights were violated so the video evidence was thrown out.

So should a guy be allowed to do something like this? Why or why not? If the wife wakes up from the coma, finds out he did this, and does not have any objections is it still so horrible? Will this possibly affect future relationships by making some people require written permission to do this in case it happens? Do you think this would make good porn? How much do you think people would pay for that kind of porn?

Mostly I want to know what your views are on a man having sex with his comatose wife.

It's creepy for starters, but the main issue with it is that by having sex w/ a comatose women he is denying her the right to say no. Maybe their relationship was on the rocks before she dropped into a coma and she wouldn't appreciate this act on his part. But yes on the other side of the argument she may be glad he still finds gratification from her and does not have to go outside their relationship, but it all comes back to the main point, he is not giving her a chance to say no since she is in a coma and that's what people will see as a violation.

However, because the person was denied a right of privacy, the case could be thrown out, because being denied your rights is considered worse than any other crime. That means if they want to make a case about it, they have to walk in on him doing the deed.

What? This screams illegal to me. On the other hand, I'm not a legal expert. This could be considered perfectly acceptable, but it doesn't seem that way to me. In my opinion this is no more than rape, for the person in question isn't even in a condition to have sex! She's in a coma for god sakes! Can that man be that depraved that he needs to have sex with someone who isn't even fully aware? Plus I didn't think it was a good idea to have sex with a woman in a coma because there may be unexpected consequences due to the physical strain of sex on the body.
